Acceptance of Terms

By enrolling as a member, entering the premises, using the facilities, or accessing the services of Tara Fitness Studio ("Tara Fitness", "we", "us", or "our"), you ("Member" or "you") agree to be legally bound by these Terms & Conditions. These terms constitute a binding legal agreement between you and Tara Fitness Studio, located at Mokdampur Market, 2nd Floor, P.S. English Bazar, Malda, West Bengal — 732101.

If you do not agree to these terms, you must not use our facilities or services.

By signing your membership agreement or using our facilities, you confirm that you have read, understood, and agreed to these Terms & Conditions in full.

Section 02

Membership & Enrolment

Eligibility

Membership at Tara Fitness Studio is open to individuals aged 15 years and above. Members between 15 and 18 years must have written consent from a parent or legal guardian. We reserve the right to refuse membership to any individual at our sole discretion.

Membership Plans

  • Monthly — ₹1,000/month: Full gym access (6 AM–9 PM), all equipment, free weights, locker & changing room. Admission fee applicable.
  • Monthly + Treadmill — ₹1,400/month: Everything in Monthly plus treadmill access. ₹1,000 admission fee applicable. Pay 3 months advance to waive admission.
  • Quarterly — ₹3,000 (without Treadmill): 3-month gym access with all standard equipment.
  • Quarterly + Treadmill — ₹3,900: 3-month access including treadmill.
  • Yearly + Treadmill — ₹13,500: Full year access with treadmill included.
  • Personal Training — ₹5,000/month: Dedicated personal trainer, custom workout plan, diet guidance, and 1-on-1 coaching sessions.

Membership ID & Access

Upon enrolment, each member is issued a unique Membership ID. Your membership is personal and non-transferable. Allowing another person to use your membership or facilities access is a violation of these terms and may result in immediate termination.

Renewal

Memberships must be renewed before the expiry date to ensure uninterrupted access. Tara Fitness will send renewal reminders via SMS and WhatsApp. Lapsed memberships do not carry forward unused days unless otherwise agreed in writing.

Section 03

Member Code of Conduct

All members are expected to maintain respectful, professional, and safe behaviour within our studio at all times. By becoming a member, you agree to:

  1. Treat all staff, trainers, and fellow members with respect and courtesy at all times
  2. Wear appropriate gym attire including proper footwear — no slippers, sandals, or bare feet on the gym floor
  3. Use a towel while using equipment and wipe down machines and benches after every use
  4. Return all free weights, dumbbells, and equipment to their designated storage areas after use
  5. Refrain from using mobile phones for calls on the gym floor — conduct calls in designated areas
  6. Not engage in unsolicited coaching or training of other members unless you are a certified Tara Fitness trainer
  7. Maintain personal hygiene — arrive clean and avoid strong fragrances that may disturb others
  8. Not bring outside food or drinks other than plain water in closed bottles onto the gym floor
  9. Report any equipment damage, malfunction, or safety hazard to staff immediately
  10. Not photograph or record other members without their explicit consent

Violation Warning: Failure to comply with the Code of Conduct may result in a formal warning, temporary suspension, or permanent termination of membership without refund.

Section 04

Fees & Payment

Payment Policy

Membership fees are payable in advance for the selected duration (monthly, quarterly, half-yearly, or annually). Payment may be made by cash, UPI, debit/credit card, net banking, or cheque. All fees are in Indian Rupees (INR) and inclusive of applicable taxes.

Fee Revisions

Tara Fitness reserves the right to revise membership fees with a minimum of 30 days' written notice to existing members. Revisions will not apply to memberships already paid for the current active period.

Late Payment & Lapsed Access

Access to facilities will be suspended on the day following the expiry of your membership period if renewal payment is not received. Tara Fitness is not liable for any inconvenience caused by suspension due to non-payment.

Official Receipts

An official payment receipt will be issued for every transaction. Members are advised to retain receipts for their records. In case of payment disputes, the receipt serves as the primary proof of payment.

Facility Rules & Operating Hours

Operating Hours

  • Monday to Saturday: 6:00 AM – 9:00 PM
  • Sunday: Closed
  • Special hours during public holidays or festivals will be communicated in advance via WhatsApp

Gym Floor Rules

  • Members must check in at the front desk or via membership ID upon every visit
  • Maximum occupancy rules must be respected — staff may ask members to wait during peak hours
  • Personal training sessions must be booked in advance and are subject to trainer availability
  • Lockers are available for day use only — items left overnight will be removed
  • Tara Fitness is not responsible for loss or theft of personal belongings on premises
Section 06

Health, Safety & Medical Disclaimer

Physical exercise involves inherent risks of injury. By using our facilities, you voluntarily assume all risks associated with gym training. Tara Fitness strongly recommends that you:

  • Consult a qualified medical practitioner before beginning any exercise programme, especially if you have a pre-existing health condition
  • Disclose any medical conditions, injuries, or physical limitations to your trainer before starting training
  • Immediately stop exercising and inform staff if you experience dizziness, chest pain, shortness of breath, or unusual discomfort
  • Follow all instructions given by our certified trainers and do not exceed your physical limits

Tara Fitness Studio does not employ licensed medical doctors. Fitness and nutrition guidance provided by our trainers is for general wellness purposes and does not constitute medical advice. For medical concerns, consult a qualified doctor.

Section 07

Limitation of Liability

To the fullest extent permitted by applicable Indian law, Tara Fitness Studio, its owner, managers, employees, and trainers shall not be liable for:

  • Personal injury, illness, or death arising from use of our facilities or equipment, except where caused by gross negligence or wilful misconduct by our staff
  • Loss, theft, or damage to personal property, clothing, or valuables brought onto our premises
  • Indirect, incidental, or consequential damages arising from your use of our services
  • Temporary closure due to maintenance, government orders, natural disasters, or force majeure events

Our maximum aggregate liability to any member shall not exceed the amount paid by that member for their current membership period.

Section 08

Intellectual Property

All content on the Tara Fitness Studio website, including text, graphics, logos, images, training programmes, and nutritional plans created by our team, is the exclusive intellectual property of Tara Fitness Studio and is protected under Indian copyright law.

You may not reproduce, distribute, modify, or commercially exploit any content from our website or gym without our express written permission. Personalised training plans provided by our trainers are for your individual use only.

Section 09

Termination of Membership

By Member

Members may cancel their membership at any time by submitting a written cancellation request to the gym manager. Refunds for early cancellation are subject to our Refund Policy.

By Tara Fitness Studio

We reserve the right to terminate or suspend any membership immediately in these circumstances:

  • Violation of the Member Code of Conduct, facility rules, or these Terms & Conditions
  • Abusive, threatening, or aggressive behaviour toward staff, trainers, or other members
  • Providing false or misleading information during enrolment
  • Non-payment of membership fees beyond the grace period
  • Any conduct determined to be harmful to the studio's reputation, operations, or community

In cases of termination due to misconduct, no refund will be issued for any remaining membership period.

Section 10

Governing Law & Disputes

These Terms & Conditions shall be governed by the laws of India, applicable to the State of West Bengal. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Malda, West Bengal, India.

We encourage members to first attempt to resolve any grievance through direct communication with our management. If a dispute cannot be resolved informally within 30 days, either party may pursue legal remedies through the appropriate Malda courts.

Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.
